Terms & Conditions (Website & Sales)

These Terms & Conditions (“Terms”) govern (i) your use of poolparthub.com (the “Website”) and (ii) purchases of products sold through the Website (“Products”). By using the Website or placing an order, you agree to these Terms.

1) Seller information

2) Scope (B2C and B2B)

We sell to:

  • Consumers (B2C): individuals acting mainly outside their trade/business; and
  • Businesses/Professionals (B2B): individuals or entities acting for professional purposes.

Some provisions (such as withdrawal/cooling-off rights) apply only to consumers. Mandatory consumer laws in your country may provide additional rights; those rights always prevail.

3) Website use

You agree not to misuse the Website, including attempting unauthorized access, interfering with security, introducing malware, using the Website for fraud, or violating applicable law. We may restrict access or cancel orders where reasonably necessary to prevent fraud or misuse.

4) Product information and compatibility (important for spare parts)

  • We strive to ensure Product descriptions, images, and specifications are accurate. Images may be illustrative.
  • Compatibility is your responsibility, especially for spare parts/components. If you are unsure, contact support@poolparthub.com before ordering with model/serial details.
  • All Products sold are new.

5) Prices, VAT, and invoices

  • Prices are shown in EUR unless stated otherwise.
  • Prices displayed are VAT (IVA) included where applicable.
  • Shipping costs and any additional fees are shown at checkout before payment.
  • We issue an invoice for every order.

6) Payment

Payments are processed via Stripe. Available payment methods may include card, PayPal, bank transfer, Bizum, Klarna, and other local options depending on your location and checkout availability. Payment may be subject to additional terms of the chosen payment method provider.

We may refuse, cancel, or place an order on hold where reasonably necessary to prevent fraud, comply with law/sanctions, or resolve payment/verification issues.

7) Orders and contract formation

  1. Adding items to the cart does not reserve stock.
  2. When you place an order, you make an offerffer to purchase.
  3. A binding contract is formed when we accept your order (typically by sending an order confirmation and/or dispatch confirmation).
  4. If we cannot fulfill an order (e.g., stock error), we will inform you and refund any amounts paid for the unavailable item(s).

8) Order cancellation before dispatch

If you want to cancel an order before it is dispatched, you must contact support as quickly as possible at support@poolparthub.com with your order number.

  • If the order has not been dispatched yet, we will do our best to cancel it.
  • If the order has already been dispatched or cannot be stopped, you may need to follow the return/withdrawal process described in these Terms.

9) Shipping and delivery

9.1 Delivery locations and methods

  • We ship worldwide.
  • We offer standard and express shipping (availability depends on destination and product).
  • Shipping/handling time may be shown per product. Transit time depends on destination and courier.

9.2 Customs, duties, and taxes (including Canary Islands / Ceuta / Melilla)

For deliveries where import duties, customs fees, brokerage fees, or local taxes apply (including Canary Islands, Ceuta, and Melilla), these are paid by the customer.

If a shipment is refused or abandoned due to unpaid import costs, we may deduct return shipping and handling costs from any refund to the extent permitted by law.

9.3 Passing of risk

For consumers, risk of loss or damage generally passes when you (or a person you appoint) take physical possession of the goods, subject to mandatory law. For business customers, risk passes as agreed at checkout or under applicable law.

10) Inspection on delivery + reporting transport damage (3 days)

Please inspect your parcel as soon as reasonably possible after delivery.

If the parcel or Products are damaged in transit, missing, or incorrect:

  • Notify us within 3 days of receiving the item.
  • You must complete the carrier-claim document we provide and supply any requested evidence (e.g., photos of the outer box, label, internal packaging, and the item).

After evaluation and/or the carrier claim is accepted, we will either:

  • ship a replacement, or
  • issue a refund, depending on stock availability and the case outcome.

This reporting window does not reduce any non-waivable rights you may have under applicable law.

11) Consumer right of withdrawal (EU/EEA – 14 days)

11.1 When it applies

If you are an EU/EEA consumer buying at a distance, you generally have the right to withdraw from your purchase within 14 calendar days from the day you (or your nominee) receives the goods, without giving a reason, subject to legal exceptions.

11.2 How to exercise withdrawal

Email support@poolparthub.com before the deadline with:

  • order number,
  • the Products you wish to return,
  • date received,
  • your name and address.

11.3 Return address

All approved returns must be sent to:

11.4 Return shipping cost

When you withdraw because you changed your mind, you pay the return shipping cost to our warehouse in Spain (unless mandatory law requires otherwise).

11.5 Condition of returned goods (sealed/unopened)

You may handle goods only to the extent necessary to determine their nature, characteristics, and functioning. If handling goes beyond that and reduces value, you may be responsible for that diminished value.

Our return condition: change-of-mind returns are accepted only for goods that are sealed and/or unopened, unless mandatory law provides otherwise.

11.6 Refunds

We will refund eligible amounts after we receive the returned goods or proof of return (as applicable), using the original payment method unless otherwise agreed.

12) Returns outside EU withdrawal / non-consumer returns

For customers outside the EU/EEA, and for B2B purchases, returns are accepted only where:

  • the goods are sealed/unopened, and

  • the return is approved by us in writing, and

  • the customer pays return shipping to Spain (unless we agree otherwise).

We do not offer exchanges — refunds only (where eligible).

13) Legal guarantee (warranty)

We provide only the legal warranties required by applicable law.

If you are a consumer, your statutory rights regarding defective or non-conforming goods apply. For business customers, warranty rights may be limited to the extent permitted by law.

14) Installation and use (spare parts)

Some Products may include instructions; many spare parts do not.

  • You are responsible for ensuring correct installation and suitability.
  • We are not liable for damage caused by incorrect installation, misuse, lack of maintenance, or using non-compatible parts.
  • Where professional installation is recommended for safety/performance, you should use a qualified technician.

Nothing in these Terms excludes liability that cannot be excluded under mandatory law.

15) Hazardous goods (chemicals/batteries) – special conditions

Certain Products may be classified as hazardous/dangerous goods (including some chemicals and batteries).

For these Products:

  • Shipping methods may be restricted by destination/courier/service level.
  • Additional packaging, labeling, handling time, and surcharges may apply.
  • Returns may be refused if the item is opened, unsealed, activated, installed, or otherwise unsafe to transport.

16) Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential losses (including loss of profit, revenue, or business interruption).
  • Our total liability connected with an order is limited to the amount paid for that order.

This does not apply where liability cannot be limited by law (e.g., fraud, or certain consumer rights).

17) Intellectual property

All content on the Website (text, images, logos, product data, and design) is owned by or licensed to POOLPARTHUB S.L. You may not copy, reproduce, or use it for commercial purposes without prior written permission.

18) Communications and language

We communicate primarily by email. Support may be provided in any language using translation tools. In case of ambiguity, our internal records and the legally applicable language of the contract documents will prevail.

19) Privacy

Personal data is handled according to our Privacy Policy and Cookie Policy, available on the Website.

20) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date indicates when changes were made. The version in effect at the time of your order applies to that order.

21) Governing law and jurisdiction

These Terms are governed by the laws of Spain.

  • If you are a consumer, you may bring claims in the courts of your place of residence where mandatory consumer law allows.
  • If you are a business customer, the courts of Alicante (Spain) shall have jurisdiction, unless mandatory law provides otherwise.
